U.S. shoppers don't have one deadline or automatic refund rule for every defective-product dispute. The seller's return policy, written warranty, marketplace procedure, payment method, and state law may affect what you can request and when you must act. The Consumer Rights Act 2015 cited in some online templates is UK law, not a general rule for U.S. purchases.
The Federal Trade Commission's guidance on resolving problems with a business recommends explaining the problem clearly, naming the resolution you want, and keeping notes and copies of your communications.

Use this as the first message to a retailer or marketplace seller. Replace every bracketed item and delete anything that doesn't apply.

A requested reply date is not automatically a legal deadline. Choose a reasonable date you can track, such as 7 to 10 days after sending, unless the seller or platform gives you a different timeframe.
What to include in a defective-product complaint
Put enough information in the first message for a support agent to identify the transaction and understand the proposed solution.
- Order details: Include the order, invoice, or transaction number; purchase date; delivery date; item name; and price.
- Observable symptoms: Write what happened and when. "The blender shuts off after 20 seconds and smells of burning" is more useful than "This is junk."
- Requested remedy: Ask for one primary outcome, such as a full refund, replacement, or warranty repair.
- Instructions and use: If you used the product according to its instructions, say so. Don't call the problem a manufacturing defect unless you have evidence supporting that conclusion.
- Supporting documents: Attach copies of the receipt, product listing, warranty terms, photographs, video, and earlier correspondence when relevant.
- Return arrangements: Ask whether a return is required and who will provide or pay for return shipping. Don't assume the answer.
- Response date: State when you want an update and ask for a specific action plan.
Keep original receipts and documents. Redact unnecessary payment details, government identification numbers, and other sensitive information before sending attachments.
Before sending the email
- Stop using a potentially unsafe product. If it is overheating, sparking, leaking, or otherwise dangerous, move away from it and follow the seller's or manufacturer's safety instructions.
- Preserve the evidence. Photograph the defect, packaging, shipping label, serial number, and product listing. Keep the item and packaging unless a safe disposal or return instruction applies.
- Check the applicable policy. Review the retailer's return terms, marketplace order page, written warranty, and instructions for reporting damage or defects.
- Use the official support channel. Send the complaint through the email address, order page, or help form connected to the purchase. Use the same order details throughout.
- Save your records. Keep a copy of the message, attachments, chat transcript, case number, and submission date. For online chats or forms, save a copy or take a screenshot before leaving the page.
- Check your payment method early. A merchant refund request and a credit-card, debit-card, or payment-provider dispute are separate processes. Ask the provider about its eligibility rules and deadline before waiting too long.
What controls the dispute?
The seller's return policy
Many businesses set return or exchange windows. The FTC gives 30 or 90 days as examples of time limits after which many stores won't accept returns or exchanges. The policy may also set conditions about packaging, item condition, exclusions, and whether the seller offers a refund or exchange.
Missing an ordinary return window doesn't necessarily answer every question in the dispute. A written warranty, product listing, payment provider's rules, and applicable state law may also matter. Ask the seller what process applies instead of assuming that the return window ends every possible remedy.
A written warranty
A written warranty may explain which defects are covered, how long coverage lasts, which repairs or parts are excluded, and whether the seller or manufacturer handles the claim. The FTC's warranty guide recommends checking the written limitations and claims process.
A warranty claim should use the warranty's terminology and include proof of purchase. Don't promise that a warranty guarantees a refund. Depending on its terms, the remedy may be a repair, replacement, or another form of service.
Implied warranties and state law
The FTC describes an implied warranty of merchantability as a seller's promise that a product will do what it's supposed to do. Whether an implied warranty applies, how it can be limited, and what remedy may be available can depend on state law and the transaction.
A U.S. complaint shouldn't cite the Consumer Rights Act 2015 or state that every buyer has a universal 14-day refund right. If the amount is substantial or the seller disputes your rights, consult a qualified consumer-law professional in your state.
Marketplace protection
Amazon, Etsy, and other marketplaces have their own case procedures and eligibility conditions. A marketplace guarantee is a platform process; it isn't the same as a written warranty or a state-law claim.
Use the current instructions on the order page. Policies can vary by marketplace, location, payment method, order type, and date.
A payment-provider dispute
If the seller doesn't respond or refuses a remedy, contact the company that handled the payment. Ask whether its dispute process covers defective merchandise or an item that was not as described. Ask for the filing deadline and the evidence it requires.
Be accurate. If you made the purchase, you authorized it, so don't report it as an unauthorized transaction merely because the product was defective. If the seller later issues a refund, tell the payment provider and don't seek payment twice.

How to escalate a defective-item dispute
Keep a dated record of each step and protect any payment-provider deadline before waiting for a seller response.
- Follow up with the seller. Restate the defect and requested remedy in one short message. Include the original case number.
- Use the marketplace's case system. If the order qualifies, submit the claim through the platform rather than relying only on an email exchange.
- Submit a warranty claim. Contact the party named in the warranty and follow its inspection or return instructions.
- Ask your payment provider about a dispute. Do this promptly because the provider's deadline may not match the seller's return window.
- Consider local help for a significant loss. A state consumer-protection office or qualified attorney can explain options that depend on state law.
Don't threaten a chargeback in every first message, accuse the seller of fraud without evidence, or open multiple overlapping cases without explaining what has happened.
